The ability to post bail will often depend on the severity of the charges a person is facing. The bail amount set by a judge may be based on whether a person has been charged with a misdemeanor or felony offense. Other factors that may affect bail include previous arrests or convictions and the possibility that a person will fail to show up for future legal proceedings.

The severity of theft charges will depend on the amount of money or the value of goods or services that a person is accused of stealing. In Texas, the potential charges for theft include:

  • Theft of less than $100 - Class C misdemeanor. The maximum penalty for this offense is a fine of $500.

  • Theft of $100 to $750 - Class B misdemeanor. A person who is convicted may be sentenced to up to six months in jail and fined up to $2,000. 

  • Theft of $750 to $2,500 - Class A misdemeanor. A person who is convicted may be sentenced to up to one year in jail and fined up to $4,000.

  • Theft of $2,500 to $30,000 - State jail felony. A person who is convicted may be sentenced to six months to two years in jail and fined up to $10,000.

  • Theft of $30,000 to $150,000 - Third degree felony. These charges may also apply if a person is accused of stealing controlled substances worth up to $150,000 from a pharmacy, medical facility, or vehicle used to transport drugs. A person who is convicted may be sentenced to two to 10 years in jail and fined up to $10,000.

  • Theft of $150,000 to $300,000 - Second degree felony. These charges may also apply if a person is accused of stealing an ATM or its contents that are worth up to $300,000. A person who is convicted may be sentenced to two to 20 years in jail and fined up to $10,000.

  • Theft of more than $300,000 - First degree felony. A person who is convicted may be sentenced to five to 99 years in jail and fined up to $10,000.

Burglary is a charge that is often related to theft. This offense involves entering a building with the intent to commit theft, assault, or another type of felony. Burglary is generally charged as a state jail felony. However, a person may be charged with a third degree felony if they enter a commercial building where controlled substances are stored, and second degree felony charges may apply if burglary occurs in a home or another building where people live.
